Coronavirus: An update from the High Court

The High Court has handed down judgment yesterday on the business interruption test case, finding in favour of the FCA and policyholders on the majority of issues. A full copy of the decision can be found on the FCA’s website here:

Whilst this may be welcome news for some policyholders, there is still some distance left to travel. There will, almost certainly, be appeals on behalf of insurers and there are many areas that still appear unclear as to how claims may be dealt with.

All insurers with effected wordings have been ordered to contact their policyholders to explain their position and individual letters will follow to those businesses identified.

I am also working on your behalf to ensure that, if I feel you have a possible claim under any of your insurance policies, that your position is noted and we can take further steps at the earliest possible time.
